CALL TO ORDER

The meeting was called to order at 6:00 p.m. by Mayor Berkemeier

CITY COUNCIL MEETS IN CLOSED SESSION FOR THE REASONS INDICATED BELOW

Mayor Berkemeier stated Council would meet in closed session for the reason indicated on the attached notice.

RECONVENE TO OPEN SESSION

The meeting was called to order at 7:00 p.m. by Mayor Berkemeier.

CLOSED SESSION ANNOUNCEMENT

Mayor Berkemeier stated there was no action to report from closed session.

APPROVAL OF MINUTES AND NOTICE OF WAIVING READING

1. Regular meeting of November 14, 2001.

-- Notice of waiving the reading of all ordinances introduced and/or adopted under this agenda

It was moved by Gilardi, seconded by Kurvers, to approve the minutes of November 14, 2001 and to waive the reading of all ordinances introduced and/or adopted under this agenda.

ORAL AND WRITTEN COMMUNICATIONS

Announcements

-- You are warmly invited to join in the annual Holiday Tree Lighting event in La Plaza Park at 6:00 p.m. on Wednesday, December 5th. At 6:30 p.m., across the street at the Fire Station, Santa will greet the kids and there will be cookies, Hanukkah crafts and caroling.

-- Reminder - City offices will be closed from Friday, December 21 through Tuesday, January 1. There will be no second City Council meeting in December. The next regular meeting will be Wednesday, January 9, 2002. Happy holidays!

-- It's not too early to mark your calendars for the Pasta Dinner and Bingo fundraiser for the Kids Parade. This fun community event will be held on Saturday, February 23 from 5 to 8 p.m. at the City Corporation Yard.

Mayor Berkemeier called attention to the announcements.

Report by Honorary Mayor

-- Rick Descano, Technology High School

Honorary Mayor Descano reported on current events at school and in the community, as well as some ideas for improving Cotati. He expressed concern about the overcrowding at Rancho Cotati High School and suggested Cotati approach Rohnert Park regarding the problem. He asked that a skate park be established as soon as possible to provide positive activities for young people.

Mayor Berkemeier presented him with a certificate of appreciation and thanked him for participating as Honorary Mayor.

Correspondence and Presentations

2. Correspondence from Theresa Eaton requesting purchase and planting of a memorial tree

Theresa Eaton, 117 Silver Drive, spoke of her mother, Geraldine Eaton, who spent her last days at Charles Street Village.

3. Cotati Chamber of Commerce Quarterly Report for Period Ending September 30, 2001

Chamber Vice President Christina Swan summarized the quarterly report and responded to questions from Council.

George Barich, 176 W. Cotati Oaks Court, said he does not doubt the good projects achieved by the Chamber of Commerce, but said he felt the money the City is giving the Chamber could be better used for youth facilities instead. He said he would like the City to spend its money, on worthwhile projects and let the Chamber fund itself, which he is confident it could do. Mayor Berkemeier responded that the Chamber is a contractor of the City, and does not receive monies as a gift.

Proclamation

4. Acknowledging the Contributions of Letter Carriers, Clerks and Mail Handlers of the United States Postal Service

Vice Mayor Orchard read the Proclamation and Mayor Berkemeier presented it to Jerry Anderson, Executive Vice President, Local 183 of the National Association of Letter Carriers, to Dave Swaney, American Postal Workers Union, and to Creighton Bell of the Cotati Post Office.

Mayor Berkemeier announced that Item No. 8, regarding design of the police facility, will be considered at the regular meeting of January 9, 2002 rather than tonight.

CITIZEN BUSINESS

Don Van Dyke, 466 Christensen Lane, read a letter from the City to the Rancho Adobe Fire Protection District regarding certain proposed projects to be undertaken in connection with issuance of tax increment bonds. He requested he be provided with a copy of the Official Statement.

George Barich, 176 W. Cotati Oaks Court, discussed a recent Design Review meeting which focused on the police facility. He praised Member John Rock’s comments regarding certain design features. He also spoke highly of the Planning Commission’s actions in requiring the architect to include important features wanted by the City.

COUNCILMEMBER DIRECTION ON FUTURE AGENDA ITEMS

Councilman Fox asked how the memorial tree for Ms. Eaton will be selected. City Manager Shaddox responded that he and Assistant City Manager Dorch will work with Ms. Eaton to select type and location of the tree.

CONSENT CALENDAR

5. Schedule workshop on skateboard park for Saturday, January 26, 2002, from 9:00 a.m. to noon.

It was moved by Orchard, seconded by Fox, to approve the Consent Calendar.

JOINT MEETING OF CITY COUNCIL AND REDEVELOPMENT AGENCY BOARD OF DIRECTORS

Consent Calendar

6. Approval of warrants and audited claims for the period November 8-20, 2001.

It was moved by Gilardi, seconded by Kurvers, to approve the Consent Calendar.

Regular Agenda

7. Adoption of Resolution No. 01-115 and CRA-156 Amending the Mobilehome Park Space Rent Stabilization Program Administration Fee Pursuant to Cotati Municipal Code Section 19.14.070, Authorizing Refund of Excess Fees Collected, and Superseding Resolution No. 99-07 and CRA -108; introduction of Ordinance No. 723 Codifying the Procedures for Assessing and Collecting the Rent Stabilization Administration Fee (Admin. Analyst)

City Manager Shaddox gave a brief report and responded to questions from Council/Board.

Theresa Eaton, 117 Silver Drive, expressed concern about mobilehomes which have been purchased by park owners and, in turn, rented out. She said she hopes the City will not award money to people who are thwarting the rent control laws.

It was moved by Orchard, seconded by Fox, to adopt Resolution No. 01-115 and CRA-156 Amending the Mobilehome Park Space Rent Stabilization Program Administration Fee Pursuant to Cotati Municipal Code Section 19.14.070, Authorizing Refund of Excess Fees Collected, and Superseding Resolution No. 99-07 and CRA -108.

It was moved by Orchard, seconded by Kurvers, to introduce Ordinance No. 723 Codifying the Procedures for Assessing and Collecting the Rent Stabilization Administration Fee.

8. Provide direction regarding design of City of Cotati Police Facility (City Manager/ Executive Director)

City Manager/Executive Director Shaddox reviewed meetings held recently on the subject of energy conservation measures that can be provided in the police facility. It appears that good information on that subject can be developed in time for Council/Board’s regular meeting of January 9, 2002.

City Manager/Executive Director Shaddox went on to recommend that a Council/Board subcommittee be formed to work with energy consultants. Following brief discussion, Vice Mayor Orchard and Councilwoman Gilardi were appointed to the subcommittee. The Planning Commission will also provide two representatives.

At the request of staff, Mayor/Board Chair Berkemeier directed that this matter be rescheduled to the regular meeting of December 12, 2001.

The joint meeting was adjourned, and the regular City Council meeting reconvened, at 7:47 p.m.
