MINUTES for the Regular Meeting of the Planning Commission

Chairwoman Moore called the meeting to order at 7:00 p.m.

III. APPROVAL OF MINUTES
A. For the Regular meeting on September 17, 2001
It was moved by Commissioner McClelland to approve the minutes of September 17, 2001, as submitted. Second by Commissioner Mulligan.

VI. MATTERS AT HAND
A. Request for approval of Design Review, a Negative Declaration, and a modification to a Conditional Use Permit to allow expansion of an existing warehouse facility from 20,538 square feet to 40,734 square feet, including 4,500 square feet of truck loading space. This application also proposes a Lot Merger combining two adjacent parcels, AP# 144-010-041 with AP# 144-010-083, to accommodate the development.

Director of Planning Dorch presented the staff report and reviewed outstanding issues related to the project. These issues were parking, internal circulation, and landscaping.
In response to an inquiry from Chairwoman Moore, Director of Planning Dorch confirmed that increasing the landscaping strip width adjacent to the Laguna de Santa Rosa would result in further problems with parking and circulation. Staff is looking for consistency with surrounding properties. The Design Review Committee approved the plan, however, with a two-foot landscape strip planted with Star Jasmine.
In response to an inquiry from Commissioner McClelland, Director of Planning Dorch estimated that only one or two trucks would be backing up to the loading dock per day. He did not believe this to be significant in an industrial area.
The PUBLIC HEARING was opened at 7:14 p.m.
Marc Matulich, the project architect, represented the application. He stated that the truck loading takes place between 1 and 5 a.m. when there is no street traffic. Most of their trucks will be able to circulate through the site, only the largest might have difficulty. The trash enclosure has been modified to a trapezoidal shape to help with the truck circulation, and bollards have been added to protect the building. The owner does not anticipate any additional employees that would necessitate additional parking.
Concerning the landscaping, he said that they propose a two-foot wide strip bordering the Laguna de Santa Rosa, with a slatted fence and Star jasmine. He discussed what he has seen on adjacent properties and believes that his proposal is consistent.
Mr. Matulich requested that the Planning Commission delete suggested conditions #9 and #16.
Condition #9 requires a five-foot landscape strip planted with trees along the property bordering the Laguna de Santa Rosa. Condition #16 requires a traffic engineer certification of adequate site circulation.
In response to an inquiry from Commissioner Mulligan, Director of Planning Dorch said that he could accept deleting conditions #9 and #16. Condition #9 would interfere with truck circulation and the City should attempt to meet the needs of industrial businesses. With reference to condition #16 that requires the traffic engineer certification, he said that the potential problem has been pointed out to the property owner, and if he believes that the truck circulation will be adequate without damaging his building, then staff would agree to delete the condition.
The PUBLIC HEARING was closed.
It was moved by Commissioner McClelland to recommend approval of Design Review, a Negative Declaration, and a modification to a Conditional Use Permit to allow expansion of an existing warehouse facility from 20,538 square feet to 40,734 square feet, and the lot merger at 441 Houser Street, subject to the suggested conditions of approval, deleting condition #9 and condition #16. Second by Commissioner Mulligan.

Conditions of Approval (as amended):
PLANNING DEPARTMENT
- The color of the metal siding and roof shall be a non-glare shade.
- Applicant shall provide site details including such items as fencing, trash enclosure, lighting, benches (if any) and bike racks, for Final Design Review approval.
- Applicant shall submit plans for exterior lighting, including illumination that highlights entry points and parking lot areas, for Final Design Review approval. No nuisance light spillover or glare onto adjacent properties is permitted.
- Applicant shall provide detailed landscape and irrigation plans for Final Design Review approval.
- The applicant shall provide a color rendering and materials samples at Final Design Review. The color rendering shall include the existing Cotati Food Services building with the planned addition.
- No more than 30% of all parking spaces shall be compact, with minimum dimensions of 8’ x 16’. The remainder of the parking spaces shall have standard dimensions of 9’ x 18’.
- The driveway around the new building shall be marked as a one-way driveway as indicated on the Site Plan.
- Improvements shall not begin within ten feet of the top of the bank of the Laguna de Santa Rosa.
- DELETED.
A minimum five-foot landscape border shall extend along the portion of the property bordering the Laguna de Santa Rosa. The landscape border shall be planted with native trees.
- The applicant shall include topographic details on the Site Plan for Planning Commission review.
- The applicant shall provide written documentation of a public access easement for the sidewalk crossing the applicant’s private property adjacent to Aaron Street.
- The applicant shall sprinkle all construction areas with water (recycled when possible) at least twice a day, during excavation and other ground-preparing operations, to reduce fugitive dust emissions. Wetting could reduce particulate (dust) emissions by up to 50 percent.
- The applicant shall cover stockpiles of sand, soil, and similar materials, or surround them with windbreaks. This measure will substantially reduce wind erosion of stockpiled materials during construction, reducing the potential of the project to contribute suspended particulate (dust) concentrations when the wind exceeds 10 miles per hour.
- The applicant shall cover trucks hauling dirt and debris to reduce spillage onto paved surfaces.
- The applicant shall sweep up dirt and debris spilled onto paved surfaces immediately to reduce re-suspension of particulate matter through vehicle movement over those surfaces.
- DELETED.
The applicant shall provide documentation that the site plan meets the satisfaction of a licensed traffic engineer.
FIRE DEPARTMENT
- The applicant shall pay all required plan check and inspection fees.
- The project shall be subject to standard conditions for an automatic sprinkler system.
- The project shall be subject to standard conditions for fire department review of building plans.
- The building shall be fully sprinklered with water flow monitoring in accordance with the requirements of the Rancho Adobe Fire Protection District.
- The applicant shall install a complete fire alarm system in accordance with NFPA 72.
- Any required on-site fire hydrant(s) shall be installed and in service before any construction starts on this project. Applicant shall check with fire department for location.
- All exit signs and emergency lighting shall be in accordance with the 1998 California Building Code.
- Applicant shall provide a Fire Department lock box for this building. Applicant shall contact Battalion Chief Fred Bechtold to process the application for a lock box prior to completion of the project (allow 4-6 weeks for processing and shipping).
- Applicant shall correct any tenant improvements that interfere with the fire sprinkler system before the Rancho Adobe Fire Protection District allows occupancy.
- All addresses on the property shall be properly displayed (twelve-inch numbers minimum) and shall be visible from the roadside in both directions of travel. Each suite shall have either a number or letter on both the main entrance door and any rear doors.
- Applicant shall install portable fire extinguishers in accordance with the Uniform Fire Code Standards and the fire department's requirements.
- Applicant shall submit and pay for all permits required by the fire department before any work is started. Fire sprinkler system, fire alarm system, fire hydrant(s) and underground fire water mains all require permits from the fire department.
- A city of Cotati Business License is required for all businesses within the City.
- Prior to final inspection, a representative of the Rancho Adobe Fire Protection District shall verify all conditions pertaining to this application.
SONOMA COUNTY WATER AGENCY
- The project shall be in compliance with the Agency's Flood Control Design Criteria.
CITY ENGINEER
Prior to the Issuance of Grading Permit and Building Permit
- Applicant shall submit the voluntary merger documents, including current title reports, closure calculations, legal description and plat map for new parcel to City Engineer for review and approval. Voluntary merger shall be recorded prior to issuance of Building Permit.
- Applicant shall submit preliminary soils report.
- Applicant shall submit site improvement plans for the review and approval of City Engineer. Said plans shall include:
- Grading and drainage plans.
- Utility plans.
- Sidewalk and landscape improvements to Aaron Avenue fronting APN 144-010-041 which conform to existing sidewalks and landscape on adjacent properties.
- All utilities shall be underground.
- Applicant shall provide site drainage for all parcels even if minimal grading occurs.
Prior to the Issuance of Encroachment Permit
- Applicant shall pay applicable permit and plan check fees and submit insurance certificates and other related documentation.
CITY ATTORNEY
- Unless shorter limitations period applies, the time within which judicial review of this decision must be sought is governed by California Code of Civil Procedure §1094.6.
- The Subdivider shall defend, indemnify and hold harmless the City or its agents, officers and employees from any claim, action, or proceeding against the City or its agents, officers or employees to attack, set aside, void, or annul an approval of the City, the City’s Council and/or the City’s Planning Commission concerning the subdivision, which action is brought within the time period provided for under Section 66499.37 of the Government Code. The City shall promptly notify the subdivider of any claim, action, or proceeding and the City shall cooperate fully in the defense thereof.
- The Conditions set forth herein include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020 (d)(1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notices that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020 (1), has begun. If you fail to file protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions.
B. Approval of an exemption for the Santero Way Specific Plan area from Growth Management Ordinance restrictions.
Director of Planning Dorch
presented a brief staff report. The largest developer of the Santero Way Specific Plan, the Colvin Group, has requested an exemption to the provisions of the Growth Management Ordinance as provided for under §17.42.040 of the Cotati Municipal Code.
In response to an inquiry from Chairwoman Moore,
Director of Planning Dorch discussed the current status of growth management allocations and the provision for carry-over.
Chairwoman Moore opened the PUBLIC HEARING at 7:30 p.m.
The PUBLIC HEARING was closed without comment.
It was moved by Vice Chairman Pagnusat to approve an exemption for the Santero Way Specific Plan from Growth Management Ordinance restrictions. Second by Commissioner Mulligan.

VII. REPORTS BY STAFF
There were no reports by staff.
III. REPORTS BY COMMISSION
Chairwoman Moore reported on a Regional Planning/Smart Growth Workshop that she recently attended. She reported that there was valuable information on both high-density housing and transportation.
Commissioner Mulligan reported a significant amount of dust in the air either from the Park Meadows site, or from the Cohousing site that is being used as a staging area for the downtown improvements.
