MINUTES for the Regular Meeting of the PLANNING COMMISSION

  5. APPROVAL OF MINUTES
  6. Chairman Pagnusat moved to approve the Minutes of the Regular Meeting of October 7, 2002, as submitted. Second by Vice Chair Mulligan.

  11. MATTERS AT HAND
    1. Request for approval of a Conditional Use Permit to allow a vehicle fabrication and customizing business at 459 Portal Street, Suite C. The project is exempt from CEQA under Section 15301 (Minor Alteration of Existing Facilities).

Planning Director Woltering presented an overview of the Staff Report. Staff recommended approval of the request for a Conditional Use Permit (CUP), subject to the suggested conditions of approval.

Chairman Pagnusat opened the PUBLIC HEARING at 7:06 p.m.

Applicant Eric Eberhart, 2802 Marlow Road, Santa Rosa, questioned conditions 2, 3, and 4, and said that he hoped that the property owner would bear the expense of the required improvements, or at least share the cost with him.

In the ensuing discussion Planning Director Woltering stated that there are permitted uses that could occupy the site without a CUP. In that case the City would not have the opportunity to require upgrades and/or improvements.

Commissioner Dutra inquired as to whether the Applicant would have recourse to the property owner as far as assuming financial responsibility for repairs and improvements. Planning Director Woltering responded the if the CUP is approved, the Applicant would have the opportunity to meet with the property owner in order to resolve the issue. Planning Director Woltering suggested a suitable time frame of 60 days could be used to complete the required improvements. If the property owner is not amenable to financing the improvements, the Applicant could request a modification to the Conditions of Approval, working with the Planning Director, and subsequently with the City Engineer.

The Applicant stated that he would like to make sure that he has acquired all the necessary permits.

Planning Director Woltering agreed to meet with the Applicant to ensure that all the permits are in order.

The PUBLIC HEARING was closed at 7:24 p.m.

It was moved by Vice Chair Mulligan to adopt Resolution No. PC 02-21 approving a Conditional Use Permit to allow a vehicle fabrication and customizing business at 459 Portal Street, Suite C, subject to the suggested conditions of approval as modified. Second by Commissioner Moore.

Amended Conditions of Approval:

Planning Department

  1. Applicant shall show proof of wastewater discharge permit.
  2. City Engineer

  3. AMENDED. Within 60 days of the date of this approval, the applicant shall remove and replace the broken (triple) drain curbs and replace them with triple 3-inch DIP curb drains and a new concrete curb and gutter.
  4. AMENDED. Within 60 days of the date of this approval, the applicant shall relocate the water meter box outside of the driveway at a location approved by the City Engineer. Said meter box will require relocation of existing meter. After the meter box is relocated and replaced with a new box, the applicant shall replace the driveway apron with new concrete.
  5. AMENDED. Within 60 days of the date of this approval, the applicant shall obtain a City encroachment permit for work within the City’s right-of-way. All work shall conform to City standards for public improvements.
  6. Rancho Adobe Fire Protection District

  7. Storage and use of flammable liquids shall be in accordance with UFC Article 79 and District Ordinances. (Fire Department permit required).
  8. Premise identification shall be visible from the roadside.
  9. A yearly business inspection shall be conducted by the Rancho Adobe Fire Protection District and any violations shall be corrected within fifteen (15) days.
  10. Police Department

  11. No vehicles associated with Performance Drivetrain shall be stored outdoors during non-business hours.
  12. The applicant shall install a burglary alarm system that is monitored by a licensed alarm company.

  2. Planning Director Woltering stated that at the November 4, 2002 meeting, Articles 2 and 3 of the Land Use Code would be reviewed.
